Novelty ID Terms
This page states the terms of service for the purchase and use of novelty identification cards sold through Fake-id.org (hereinafter referred to as “Novelty IDs”). Please read this page carefully as it constitutes a legally binding agreement between you and Fake-id.org (hereinafter referred to as the “Company”). In consideration of the Company agreeing to sell you Novelty IDs, you agree to be bound by these terms and conditions and indicate such agreement by submitting an order form as stated on the order form “By submitting this form, you have read and agree to the Terms of Service”. You and the Company are each referred to as a “Party” and collectively as the “Parties”.

General Provisions.A. Server Capacity.
Any provision or portion of these Terms of Service that is held or determined by a court of competent jurisdiction (or other legal authority) to be illegal, invalid or unenforceable in any jurisdiction shall be deemed separate, distinct and independent and ineffective to the extent of such holding or determination, but shall not (i) cause the remaining provisions of these Terms and Conditions to be invalid in such jurisdiction, or (ii) affect the legality, validity or enforceability of such provision in any other jurisdiction.
C. Governing Law.
These Terms of Service and the respective performance of the parties hereto shall be construed and governed by the laws of the People’s Republic of China. The courts of the People’s Republic of China shall have exclusive jurisdiction over any dispute or claim arising under or pursuant to these Terms of Service, and you hereby consent to the personal jurisdiction of such courts.
D. Force Majeure.
The delay or non-performance of any provision of these Terms of Service (other than non-payment of amounts due hereunder) due to circumstances beyond the reasonable control of the performing party shall not constitute a breach of these terms and conditions, and the time for performance of such provision shall be deemed extended for the duration of the condition preventing performance.
E. Assignment.
You may not assign any part of these Terms of Service, whether voluntarily or involuntarily, including, without limitation, by operation of law or merger, except with the express consent of Company, which consent shall not be unreasonably withheld. Any such attempt shall be void. No person or entity not a party to this Agreement shall have any benefit or be deemed a third-party beneficiary of this Agreement, other than Company’s indemnities, and nothing in this Agreement shall be construed to create any rights enforceable by any other person or third party other than Company’s indemnities.
F. Entire Agreement.
These Terms of Service, together with the [Order Form], constitute the entire agreement and understanding of the parties with respect to the subject matter hereof and are intended to serve as the final expression and complete and exclusive statement of the parties with respect thereto, superseding all prior or contemporaneous agreements, representations, undertakings and understandings, whether written or oral.
G. Binding Agreement.
These Terms of Service shall be binding upon and inure to the benefit of the parties and their respective estates, assigns, legal representatives, successors and permitted assigns.

Your Representations and Warranties.
You hereby represent and warrant that: a. You are at least eighteen (18) years of age; b. You understand and acknowledge that Novelty ID is for entertainment purposes only and is not intended or designed to be used or considered as evidence of your identity, likeness or age; and c. You will not use Novelty ID for (1) any illegal or unlawful purpose or in connection with or to promote any illegal or unlawful activity; (2) in violation of any applicable law or regulation; (3) in a manner that infringes or may infringe upon the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others; or (4) any conduct or activity that the Company deems to be defamatory, obscene, pornographic, offensive, threatening, abusive, hateful, tortuous or infringing upon the rights of any other person or entity.

Liability of Novelty ID.
You are solely responsible for, and the Company shall not be liable for, any loss or damage arising from your purchase, possession or use of any Novelty ID or any third party’s possession or use of any Novelty ID you purchase (whether or not such possession or use is authorized by you). You will defend, indemnify and hold harmless the Company, its directors, partners, officers, employees and agents (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, losses, damages or injuries (including, without limitation, reasonable legal and accounting fees) arising out of or related to (i) your purchase, possession or use of any Novelty ID, including, without limitation, any claims, liabilities, losses, damages or injuries arising out of or related to any third party’s possession or use of any Novelty ID purchased by you (whether or not such possession or use is authorized by you), or (ii) your breach of these Terms and Conditions. You hereby release the Indemnified Parties from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, whether known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or related to your purchase, possession or use of any Novelty ID or any third party’s possession or use of any Novelty ID purchased by you, whether or not such possession or use is authorized by you. If you are a California resident, you waive California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”

No Warranties.
You acknowledge that the Novelty ID is provided to you “as is,” “with all faults,” and “as available.” The Company makes no warranties, express or implied, contractual or statutory, with respect to the Novelty ID or any aspect thereof, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, and hereby expressly disclaims all warranties with respect thereto. The Company expressly reserves the right to change any aspect of any Novelty ID at any time, including, but not limited to, appearance, materials, or method of construction, without notice to you.

Information.
You acknowledge that the Novelty ID is customized based on the information you provide to the Company at the time of ordering. You are solely responsible for ensuring that all such information provided to the Company is complete, accurate, and clear. The Company has no obligation to contact you to verify the accuracy of the information provided (including, without limitation, to verify the spelling thereof) or to obtain missing or omitted information, and the Company assumes no responsibility for any errors, defects or nonconformities in any Novelty ID that are attributable in whole or in part to your failure to provide complete, accurate and legible information. All physical materials, including, without limitation, any photographs, that you submit to the Company when ordering Novelty IDs (“Physical Materials”) will become the property of the Company upon receipt by the Company. You are solely responsible for the physical condition of all Physical Materials, and the Company assumes no responsibility for any errors, defects or nonconformities in any Novelty ID resulting from damage to or defects in such Physical Materials, whether such damage or defects occurred before or after the Company’s receipt of the materials.

Refunds.
All fees charged for Novelty IDs ordered by you will be non-refundable once Company begins production of such Novelty IDs; however, Company will refund fees associated with defective or non-conforming Novelty IDs if: (i) Company receives written notice via email by the end of the next business day after you receive the alleged defective or non-conforming Novelty ID, which notice shall detail the nature of the alleged defect or non-conformity; (ii) you return the alleged defective or non-conforming Novelty ID to Company at your expense and Company receives such Novelty ID by the end of the fifth calendar day after you receive such Novelty ID; and (iii) Company reasonably determines that such alleged defect or non-conformity exists and is caused solely by Company’s actions or omissions, for which Company is responsible.

Shipping.
All Novelty IDs will be shipped to you via the shipping methods listed on the FAQ page; however, Company does not represent or guarantee that Novelty IDs will be shipped or delivered within any specific time frame. If the shipping method you select on your order is not available, we will select an alternative shipping method at no additional cost to the customer; the balance of shipping charges is non-refundable. Tracking numbers will be sent at the Company’s sole discretion and are not covered by the warranty or guarantee of your order. The Company shall not be liable for any damages you or any third party may suffer as a result of any delay in shipping any Novelty ID or damage incurred during or during shipping, even if the Company has been advised of the possibility of such damages.

Limitation of Liability.
Notwithstanding anything to the contrary herein, the Company’s liability (including, without limitation, any cause of action based on contract, tort or strict liability) for any loss or damage (whether direct or indirect) arising out of these Terms of Service or your purchase, possession or use of any Novelty ID purchased by you, regardless of the cause, or in connection with any third party possession or use of any Novelty ID purchased by you, whether or not such possession or use is authorized by you, shall be limited to actual direct damages incurred, but in no event shall exceed the fees you paid to the Company for the Novelty ID giving rise to such liability. The Company shall not be liable for lost profits or other consequential damages, cover damages, or any claims by any third party against you, even if the Company has been advised of the possibility of such claims. In no event shall the Company be liable for special, general, incidental, consequential, exemplary or punitive damages. You may not bring any action (regardless of form) against the Company arising out of this Agreement more than one (1) year after the cause of action accrues. This Section 8 shall survive the expiration or termination of these Terms and Conditions for any reason.
